BP SUMMER BIG SCREEN 40 SECOND FILM SUBMISSIONS
Terms and conditions

  1. You agree, by submitting your film, to grant the Royal Opera House during the licence period a non-exclusive, free licence to digitize, encode and publish your film on the Royal Opera House Website and on The Royal Opera House YouTube Channel and on the BBC's UK City Centre Big Screens and for such other purposes (such as publicity related to the Royal Opera House) as are expressly provided for in these rules.

  2. The licence period shall commence from the date you submit your film and shall continue for a 5 year period from the date of first publication of your film on the Royal Opera House Website and on The Royal Opera House YouTube Channel.

  3. During the licence period the Royal Opera House has a non-exclusive right to make your film available through streaming technology.

  4. In addition, you grant the Royal Opera House the right to sub-license your film during the licence period for the purpose of syndication of the Royal Opera House Website for use on a third party website or service (for example the Royal Opera House may permit publication of content from the Royal Opera House Website on the UK Film Council website). The Royal Opera House will not charge any fee to the third party in return for such syndication.

  5. If your contribution is published by the Royal Opera House you permit the Royal Opera House to make and retain after the licence period a copy of your film as may be required for the Royal Opera House’s own archival purposes.

  6. If you do not want to grant to the Royal Opera House the rights set out above, please do not submit your film to the Royal Opera House.

  7. The Royal Opera House reserves the right to not make use of your film for any reason at its absolute discretion.

  8. You should retain a master copy of your film because the Royal Opera House will not return the tapes or stills that you submit.

  9. Your film must be your own original work and you agree that your film will not infringe the copyright or any other rights of any third party.

  10. By submitting your film to the Royal Opera House, you:

10.1 Warrant that your film;

    10.1.1 is your own original work and that you have the right to make it available to the Royal Opera House for all the purposes specified above; and

    10.1.2 does not infringe any law;

    10.2 agree to indemnify the Royal Opera House against all legal fees, damages and other expenses that may be incurred by the Royal Opera House as a result of your breach of any of the above warranties; and

    10.3 waive any moral rights in your film for all the purposes specified above, including its submission to and publication by the Royal Opera House.

  1. Submission of your film to the Royal Opera House amounts to acceptance of these rules.

  2. If you enter into an agreement with a third party, such as a distribution agreement, and the agreement does not permit you to showcase your film on the Royal Opera House Website and on The Royal Opera House YouTube Channel, you can request that your film be removed from the site, provided you give the Royal Opera House at least 7 days' written notice. After such notice period, the licence period described in rule 2 will come to an end and you will not be subject to these rules, except for rule 5, which allows the Royal Opera House to retain a copy for archive purposes and rule 10.2 , which indemnifies the Royal Opera House against any damages.

  3. Your film is made at your own expense and the Royal Opera House shall not be liable to reimburse you for any expenses you incur in submitting your film.

  4. Your film must not contain defamatory, obscene, unlawful or objectionable material.

  5. You must be a resident of the United Kingdom.

  6. Wherever used, we agree to credit your film to you with the appropriate copyright acknowledgment.

  7. The Royal Opera House will use the personal data you submit about yourself to contact you for the purposes of this submission. The Royal Opera House will include your name (but not any other details) on the page on which your film is featured.

  8. You agree that by providing the names of third parties such as the director, cast, crew and others that those third parties have consented to you providing such personal data to the Royal Opera House and that they are aware that the Royal Opera House will use the personal data for the purpose of including the third party's name on the page on which your film is featured where applicable.

  9. The Royal Opera House does not accept any responsibility for any lost films. Proof of sending is not proof of receipt.

  10. The Editor's decision is final and no correspondence will be entered into.

  11. These rules are governed by the laws of England and Wales whose courts shall be courts of competent jurisdiction.
